PREAMBLE

WEBLIB, a société par actions simplifiée (simplified joint stock company) with capital of €217,100, registered in the Paris Trade and Companies Register under number 511 340 572, with its registered office at 10 Rue de Penthievre 75008 Paris, France, publishes two websites accessible at the following addresses:

(hereinafter collectively referred to as the “Sites” and each individually as the “Site”).

These Sites provide general information on the digital solutions that WEBLIB offers to professionals to help them get closer to their customers and employees.

The purpose of these General Conditions of Use (hereinafter the “GCU”) is to define the terms and conditions under which users of the Sites (hereinafter the “Users” or individually the “User”) access the content of the Sites offered by WEBLIB.

Access to and use of the Sites are subject to these GCU, which the User must read and accept before accessing and using the Sites.

Article 1: Access to the Site

–        Access and use

The User undertakes to check that the configuration of his/her browser and operating system allows him/her to access and consult the Websites. Consequently, Users must check that they are using a browser version that is up to date at the time of consulting the Websites. Failure to do so may result in difficulties of access or use.

WEBLIB endeavours to keep the Sites accessible, but is under no obligation to do so. It is specified that for purposes of maintenance, updating, and for any other reason, including technical, legal or security, access to all or part of the Sites may be modulated, interrupted or deleted by WEBLIB without notice. WEBLIB can in no way be held responsible for these temporary or permanent interruptions and the consequences that may result for you.

–        Restrictions on use

Except with the express prior consent of WEBLIB, all reproductions, representations and uses other than those referred to above are prohibited, in particular:

  • Any extraction and/or re-use, including for private purposes, of a qualitatively or quantitatively substantial part of the content of the databases constituted by the Sites or accessible on the Sites;
  • Any repeated and/or systematic extraction and/or re-utilisation, including for private purposes, of even a non-substantial part of the content of the databases constituted by the Sites or accessible on the Sites;
  • Any link, access, modification, addition or deletion that affects the automated processing system of the online edition and modifies the conditions of publication or the editorial policy.

The following in particular are prohibited :

  • Fraudulent access to and maintenance of an automated data processing system,
  • Fraudulently deleting, modifying or adding data to this system,
  • Obstructing this system.

Any User who acts in breach of these terms and conditions is liable to civil or criminal prosecution, in particular for infringement of copyright, neighbouring rights, the rights of database producers and/or automated data processing systems.

Article 2: Content of the Sites

–        Information on digital solutions

Each Site is a dedicated area whose purpose is to provide general information on the various digital solutions offered by WEBLIB and UCOPIA.

  • WEBLIB : Smart Wifi ; Tab InStore ; Smart Kiosk ; Order-it ; Ucopia.
  • UCOPIA: Express Lite ; Express ; Advance ; Smart Wifi ; Tab InSrore ; Order It.
  • SMILEIN : Smilein studio ; Smilein Waiter.

WEBLIB endeavours to update the information contained in the Sites on a regular basis. However, no representation or warranty is given as to the completeness or accuracy of the information contained on the Sites.

WEBLIB may, at any time and without delay, modify or update the information contained in the Sites as well as the company’s services detailed therein.

–        Contact forms

Each Site includes a contact form available to Users who wish to obtain additional information on the services of WEBLIB or UCOPIA.

The responses formulated by WEBLIB to e-mails sent via these forms, as well as access to the Sites and their contents cannot be assimilated to or constitute proof of the exercise of an advertising, promotional or commercial activity on the territory of the country where the User is located.

By entering information on the Sites, you accept that said information may be processed. If you wish to know more about how WEBLIB processes this information, please consult our Privacy Policy.

WEBLIB will not be held responsible for any direct or indirect loss resulting from the erroneous or unjustified transmission of information to a third party, nor for the unauthorized access of any third party to said information. Similarly, WEBLIB will not be responsible for inaccurate and confidential information provided as part of this service.

Article 3 : Acceptance of the GCU

Access to and use of the Site(s) are subject to acceptance of and compliance with these GCU, which the User must read before consulting the Site(s).

By consulting the Site(s), the User unreservedly accepts these GCU in their entirety and undertakes to comply with them at all times and in all circumstances.

Article 4 : Access to the WEBLIB partner area

The WEBLIB Site gives you access to the WEBLIB Partner Area, designed to increase your revenue, support your business model and facilitate communication between your employees and our teams.

To create your Partner Area, WEBLIB may ask you for personal information to enable your identification and registration.

For further information on the use of this personal information, we invite Users to refer to the Confidentiality Charter which will be made available to you when you register on the Partner Area.

 

This area dedicated to WEBLIB partners is password-protected and is accessible only to persons authorised by WEBLIB. Any unauthorised person accessing this area will be liable to prosecution.

Article 5 : Intellectual Property

All trademarks, whether figurative or not, and all other trademarks, trade names, service marks, illustrations, images, logos, videos, registered or unregistered designs and models, copyrights and patents, and more generally any sound element (hereinafter “Intellectual Property Elements”) appearing on the Sites are and remain the exclusive property of WEBLIB.

Any reproduction, in whole or in part, modification or use of the Intellectual Property Elements, for any reason whatsoever or on any medium whatsoever, is strictly prohibited without the prior express written consent of WEBLIB. This prohibition also applies to any combination or use associated with any other trademark, symbol, logo or, more generally, any distinctive sign intended to make up a logo.

Failure to comply with this prohibition constitutes an infringement that may give rise to civil and/or criminal liability of the infringer against which WEBLIB reserves the right to claim compensation for its entire loss.

Article 6 : Responsibility

–        Access to the Sites

WEBLIB undertakes to provide its best efforts to guarantee regular and uninterrupted access to the Sites. However, for reasons of maintenance, updating, voluntary or involuntary interruption, the Site may be temporarily unavailable without this interruption can engage the responsibility of WEBLIB.

WEBLIB provides no guarantee against any damage related to the use of the Internet and computer systems and telecommunications, including:

  • any imprecision, inaccuracy or omission concerning the information available on the Websites;
  • any damage resulting from computer intrusion by a third party leading to modification of the information made available on the Websites;
  • and more generally, any damage, direct or indirect, whatever the cause, origin, nature or consequences, caused as a result of access by any person to the Sites or the impossibility of accessing them, as well as the use of the Site and/or the credit given to any information coming directly or indirectly from the latter.

 

WEBLIB implements means intended to ensure the security of files constituted from personal data collected on the Site. It should be noted, however, that WEBLIB does not control the risks associated with the operation of the Internet and draws the attention of Internet users to the existence of possible risks in terms of confidentiality of data transiting via this network.

–        Limitation of liability

To the extent permitted by law, the content published and / or accessible on or via the sites are provided “as is” without any express or implied warranty of any kind whatsoever.

In no event shall WEBLIB or any third party linked to WEBLIB be liable for any direct or indirect, in connection with or arising from access to the Sites and / or use of information contained therein.

WEBLIB may not be held liable in the event of contamination of the User’s computer resources (tangible and intangible) resulting from the propagation of a virus or other computer infections. It is the responsibility of the User to take all appropriate measures to protect its computer resources.

Article 7 : Disputes and applicable law

The use of the Site and the terms and conditions of its use are governed exclusively by French law, regardless of the place of use.

IN THE EVENT OF ANY DISPUTE CONCERNING THE FORMATION, INTERPRETATION OR APPLICATION OF THESE GGU, AND IN THE EVENT OF THE FAILURE OF ANY PRIOR ATTEMPT AT AMICABLE RESOLUTION, THE FRENCH COURTS SHALL HAVE SOLE JURISDICTION TO HEAR THE DISPUTE.

Article 8 : Other

In the event that any of the provisions herein are deemed null and void by virtue of a present or future legal or regulatory provision, or of a court decision having the force of res judicata and emanating from a competent court or body, this provision shall be deemed unwritten, all the other provisions of the General Terms and Conditions retaining their binding force.

The fact that the User does not avail himself/herself temporarily or permanently of one or more clauses of these GCU shall in no way imply a waiver of his/her right to avail himself/herself subsequently of the clauses in question and/or of the rest of these GCU.

Article 9 : Update of Terms and Conditions

WEBLIB reserves the right to modify and update these GCU at any time and without prior notice.

Users are therefore advised to consult the legal terms and conditions regularly in order to keep abreast of the latest changes.
